Policy
A $5K consideration fee is required as part of the contract signing. It is intended to show proof of your interest.
Verbal agreements are not binding. Please get everything in writing and signed by a sales manager and an ANV office manager in order to be official. Many options and prices are discussed so confusion can sometimes occur.
All upgrades such as flooring, countertops, cabinets, brick, stone, siding, roof color, etc. must be chosen from our show room. If there is something other than what is in the showroom, please see a representative before signing a contract.
Electrical and plumbing upgrades come in pre-set groups only. You must choose the package in its entirety.
When there is a drywall inspection done, it must be done from four feet away from the drywall.
No outside vendors FOR ANY REASON are to be in the house while the house is under construction. Any after market work may void the warranty.
Due to theft of our intellectual property, we will not give out roof truss drawings, electrical drawings, mechanical drawings, plumbing drawings, gas drawings or engineering drawings. The only drawings we will give out are floor plans and basement drawings that have the exact dimensions of the rooms.
The time between contract signing and county approval will be approximately 2-6 months depending on your lot and county regulations. In this time the customers must make all selections, including cable and phone layouts, and any other options. Once the contract is completed and signed there will be a charge of $10,000.00 to re-open, not including the cost of the options. The only charge to re-open the contract should the county regulations require a change is the option's cost.
ANV has a traveling sales associate who is available to meet with you on weekends and evenings and occasionally at a potential customer residence. However, the rest of the ANV staff will be available during regular business hours unless prescheduled by the ANV staff member.
Payments
1) ANV will always do the work first, and then get paid for their activities. The payment amounts are based on the line item draw schedule to follow.
2) A third party inspector, which is chosen by the homeowner, will be called to check the status of the work before each draw is released.
3) The homeowner is responsible for the inspection fees. This prevents a conflict of interest.
4) If you are paying cash please refer to section (A) below. If you are using a construction to permanent loan please refer to section (B)
Section A
1) Once the contract is finalized, and the price is agreed upon, the line item draw schedule is sent to the escrow agent.
2) All funds must be in an escrow account, before construction begins. Using the law firm of escrow agent.
3) ANV will draw on those funds by calling one of many third party inspectors approved and referred by Bank of America or BB&T and approved by the Homeowner. The inspector is to confirm we have completed the work that we have requested funds for.
4) Once the inspector approves certain activities, the escrow agent will send the funds directly to ANV.
5) The homeowner can stop the funds for any reason. They must do so via certified mail or the like official notice, to both the lien agent and ANV, with the understanding that construction will come to a halt.
6) If the lien agent, the inspector, and ANV agree that certain activities are complete then the funds will be released to the contractor. The homeowner agrees that there will be no need for the homeowner to sign or approve any notices - either written or verbal - every time a draw is requested. The homeowner will be notified via contact information given above. Messages will be left if the homeowner can’t be reached.
Section B
1) The owner is to get a construction loan. ANV does not request information from the lender regarding the loan or the applicant. This includes, job description, income marital status or the like. ANV is to ask the bank if the homeowner is qualified for the required amount for construction, the suggested amount for site work and other expenses. ANV is to make sure the homeowners name and the loan applicants name match. ANV takes no responsibility for any information on the loan application, such as whether or not the homeowner is in a financial position to purchase the home.
2) It is the homeowner’s responsibility to convert the loan into a traditional mortgage.
3) Once the contract is finalized and the price is agreed upon, the line item draw schedule is sent to the bank.
4) Once the inspector approves certain activities, the bank will send the funds directly to ANV.
5) The homeowner can stop the funds for any reason. They must do so via certified mail or the like official notice to both the bank and ANV, with the understanding that construction will come to a halt.
6) If the bank, the inspector, and the contractor agree that certain activities are complete then the funds will be released to the contractor. The homeowner agrees that there will be no need for the homeowner to sign or approve any notices - either written or verbal - every time a draw is requested. The homeowner will be notified via the contact information given above. Messages will be left if the homeowner can not be reached. Once again the homeowner can stop the payments via certified mail or the like official notice, at any time for any reason.
